Terms of Service

1. Who we are and what these terms cover

These Terms of Service ("Terms") govern your access to and use of the website at thetech.plus, the associated Discord community, and the products and services offered through them (together, "The Tech" or the "Service"). The Service is operated by [INPUT: legal entity name and registration number if applicable] ("we", "us", "our").

By purchasing a subscription, booking a mentor call, joining our Discord community, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service is (and what it is not)

The Tech provides, via paid monthly subscription tiers:

• Access to a private Discord community, including mentorship and discussion channels;
• Access to a TradingView indicator, currently iFVG Pro+ (the "Indicators");
• Access to automated ORB trading tools and the Tier 3 bot portfolio (the "Tools", and together with the Indicators, "The Tech+ tools");
• The ability to book paid one-on-one mentor calls.

Purchases, subscriptions, and mentor-call bookings are completed through Whop, a third-party platform. Whop's own terms apply to each transaction and to your use of its platform.

The Service is software and education only. It is not a financial product, financial advice, an investment recommendation, a signal service constituting advice, or a managed investment scheme. We do not tell you what to buy or sell. Nothing in the Service, including bot or indicator output, strategy discussion, mentor calls, daily outlooks, or trade reviews, is personal financial advice or a recommendation to buy, hold, or sell any asset, contract, or instrument, including NQ futures, gold futures, FX, or cryptocurrency.

No member of our team is a licensed or registered financial adviser, investment adviser, or commodity trading advisor.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent that you are 18 or older and have the legal capacity to enter into these Terms.

3A. Geographic restrictions

Certain products are not available in all jurisdictions. Automated trading tools (Tier 3) are not offered to customers in Australia. The Service as a whole is not available to customers in India or Pakistan. These restrictions are applied at Whop checkout. We may refuse or refund any purchase that we determine originates from a restricted jurisdiction. You must not use a VPN, proxy, or any other means to circumvent these restrictions. Doing so is a breach of these Terms and may result in a refund and termination of access without notice.

4. Accounts and access

4.1 Access to paid content is linked to your Discord account and, where applicable, your TradingView username. You are responsible for maintaining the security of your accounts.

4.2 No account sharing. Access is personal to you. Sharing paid tier access, Discord access, TradingView invite access, bot logins, or any credentials with any other person, including through burner or secondary accounts, is strictly prohibited and may result in immediate termination without refund.

4.3 We may suspend or revoke access where we reasonably believe these Terms have been breached.

5. Subscriptions, billing, and cancellation

5.1 Subscriptions are billed monthly in advance through Whop. Prices are displayed at checkout in USD and may change with notice; changes apply from your next billing cycle.

5.2 You can cancel at any time through Whop. Cancellation takes effect at the end of the current billing period; access continues until then. We do not provide pro-rata refunds for partial months except where required by law or stated otherwise in these Terms.

5.3 If a payment fails, we may retain access for a short grace period, after which access is revoked until payment is made.

5.4 Refund policy: Refunds for subscription payments are handled in line with applicable consumer laws and our support process. If you believe there has been a billing error or exceptional circumstance, contact us and we will review the request in good faith.

5.5 Mentor calls are one-time purchases. A booked call may be cancelled or rescheduled up to 24 hours before its scheduled start time; cancellation within that window entitles you to a full refund of that booking. Inside 24 hours of the call, bookings are locked and non-refundable. If we or the mentor must cancel, you will receive a full refund or a reschedule at your option.

6. Licence and intellectual property

6.1 We grant you a personal, non-exclusive, non-transferable, revocable licence to use The Tech+ tools and community content for your own personal trading and education while your subscription is active.

6.2 All content, code, indicators, bot logic, strategies, course material, and branding remain our intellectual property or that of our licensors.

6.3 No redistribution. You must not copy, screenshot for redistribution, share, resell, publish, reverse engineer, or otherwise redistribute any paid content, indicator access, bot output, signals, or course material outside the Service.

7. Community rules (Discord)

While in our Discord community you agree to:

1. Use respectful and inclusive language. Harassment, hate speech, and discriminatory behaviour are not tolerated.
2. Keep discussions on-topic for the relevant channel; take off-topic conversation to general channels.
3. Post no unsolicited explicit or NSFW content.
4. Not share accounts or access (see clause 4.2).
5. Treat all shared content as educational only (see clause 8).
6. Not redistribute paid content (see clause 6.3).
7. Not spam or self-promote: no advertising other servers, services, or products without permission, and no unsolicited direct messages offering trading services, signals, or promised returns.

Breaches may result in a warning, timeout, removal, or ban at our discretion, depending on severity. Moderation decisions are final. Removal from the community for breach of these Terms does not entitle you to a refund.

8. Risk disclosure and educational purpose

8.1 Trading futures, FX, cryptocurrency, and other leveraged products involves significant risk of loss and is not suitable for everyone. You may lose more than your total account or portfolio balance. You should consider whether trading is appropriate for your circumstances and seek independent professional advice if in doubt.

8.2 Everything shared through the Service, including trade ideas, strategy breakdowns, bot and indicator output, mentor call content, and community discussion, is for informational and educational purposes only.

8.3 Past performance is not indicative of future results. This applies to any historical results, statistics, backtests, or hypothetical performance referenced anywhere in the Service or our marketing. No profit or performance of any kind is guaranteed or implied.

8.4 Team members, mentors, and contributors trade at their own personal discretion, at any time, without notice, and independently of any signal, strategy, or tool output shared through the Service. Nothing they share obliges them to trade accordingly, and nothing they do personally is a representation about the Service.

9. Automated tools: specific terms

9.1 The Tools generate output based on predefined logic and historical and real-time market data. They are not infallible. They may contain errors and may experience downtime, delays, data outages, or technical failures, including failures of third-party platforms they depend on.

9.2 You are solely responsible for configuration and supervision. You choose your own risk settings, position sizing, account connections, and execution platform configuration. Incorrect setup may cause the Tools to behave unexpectedly, including failing to place, manage, or exit trades. You are responsible for monitoring any account a Tool is connected to.

9.3 Prop firm and funded accounts. If you use the Tools with an evaluation or funded account, you are solely responsible for ensuring compliance with that firm's rules, including drawdown, consistency, scaling, payout, and news trading rules. We make no representation that any Tool will pass any evaluation or comply with any firm's rules.

9.4 The Tools may rely on third-party services (for example TradingView and trade execution platforms). We are not responsible for the availability, accuracy, or conduct of third-party services, and your use of them is governed by their own terms.

10. Third-party services

The Service integrates with third-party platforms including Whop, Discord, TradingView, Stripe, Google (calendar and video calls), and email delivery providers. Your use of those platforms is subject to their own terms and privacy policies. We are not responsible for their acts, omissions, or outages.

11. Disclaimers and limitation of liability

11.1 To the maximum extent permitted by law, the Service and The Tech+ tools are provided "as is" and "as available" without warranties of any kind, express or implied.

11.2 To the maximum extent permitted by law, we (including our owners, employees, mentors, contractors, and volunteers) are not liable for any loss or damage, including trading losses, loss of profits, loss of funded or evaluation accounts, or indirect or consequential loss, arising from or in connection with: content or information provided through the Service; your investments or trading decisions; the Tools or Indicators, including their errors, downtime, or output; the website or Discord community; acts or omissions of our personnel or mentors; your reliance on any results, statistics, or past performance; or your own configuration, supervision, or use of any Tool.

11.3 To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us in the [INPUT: e.g. three (3)] months preceding the event giving rise to the claim.

11.4 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify us against claims, losses, and expenses arising from your breach of these Terms, your misuse of the Service, or your trading activity, except to the extent caused by our own wrongful acts.

13. Termination

We may suspend or terminate your access for breach of these Terms. You may stop using the Service and cancel your subscription at any time. Clauses which by their nature should survive termination (including clauses 6, 8, 9, 11, and 12) survive.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified via the Service (for example, Discord announcement or email). Continued use after changes take effect constitutes acceptance.

If a dispute arises, please contact us first so we can try to resolve it directly and in good faith.
